Brexit Impact on Asset Management Industry

  • Currently Firms can market products throughout the EU, including the UK under MiFID, AIFMD or UCITS directives.
  • Regulatory turning point: UK has now left the EU and the transition period will end 31 December 2020.
  • As a consequence, UK Firms will no longer be able to market products into Europe and vice versa under the existing regulatory framework.
We then analyse the information gained from the onsite visit and prepare the report using our in-house due diligence software.

Tied Agent Solutions for UK Firms ➜ Europe

Laven’s Luxembourg firm Lumen Distribution has been created to benefit UK firms who do not have an independent entity in the EU. Lumen can assist you by working with your sales staff on a part-time basis to distribute your products throughout the EU.

  • Laven will rely on its longstanding MiFID expertise and systems for the operational and compliance oversight for any client of Lumen. 
  • Monitoring will include financial promotions, investor categorisation and AML. 
  • All of this is recorded inside our dedicated software solution Laven Tech on the Digital Compliance Assistant module.

Solutions for International Firms ➜ UK

As with UK Managers looking to access Europe, EU Managers face the same hindrances in seeking to access the UK. The UK has a well developed tied agent system called "Appointed Representatives" under which a Principal firm can host a Firm under its umbrella. Laven holds both MiFID and AIFM permissions and is authorised and regulated by the FCA. We have over a decade of hosting experience. This will enable Firms to market their EU products to UK investors subject to product registration rules.
